  1. GENERAL PROVISIONS

These general conditions of sale (hereinafter, “General Conditions”) apply to all sales of products (hereinafter, “products” or “product”) purchased through the website https://www.salumificiopevericarlo.com (hereinafter “site”).

The use of the distance selling service described in these General Conditions is reserved exclusively for consumers (hereinafter, “Customers” or the “Customer”), understood as natural persons and acting for private purposes.

The languages available to conclude the contract are Italian, English, German.

Consumer protection in online sales is governed by  Legislative Decree 206/05 of the Consumer Code and 

based on the provisions of art. 68 of the same Code, with reference, for what is not expressly regulated, to Legislative Decree No. 70/03 on e-commerce.

The buyer is obliged to carry out a thorough reading of the conditions of this contract before entering any data for the online purchase order of one or more products offered for sale on the site.

  1. IDENTIFICATION OF THE SELLER

The seller is Salumificio Peveri Carlo S. a. s. (VAT number 00405340332), via Chiaravalle 3193/1, Fraz. Chiaravalle della Colomba, Alseno (Piacenza), email: info@salumificiopevericarlo.com.

  1. PRODUCT INFORMATION

Information relating to «Salumificio Peveri» products that can be sold remotely through the Site are available on the Site.

In the event that the customer needs further information on the product, he must contact Salumificio Peveri Carlo S. a.s. by e-mail to info@salumificiopevericarlo.com.

The visual representation of the Products on the site, where available, normally corresponds to the photographic image of the Products themselves and has the sole purpose of presenting them for sale, without any guarantee or commitment regarding the exact correspondence of the image depicted on the site with the real product.

  1. PRICE

All prices are expressed in euros.

The prices of the Products are inclusive of VAT but not of transport which is subsequently calculated based on the destination.

The system is set up so as not to allow orders of less than 25 €.

SALUMIFICIO PEVERI CARLO will deliver the Products to the Customer at its own expense only and exclusively for a minimum order of € 40.00 with delivery in Italian territory. For smaller orders from Italy and for orders from EU countries, the shipping costs are calculated based on the amount reached by the requested order.

The transport prices will be indicated in the section dedicated to the summary of the total expense after loading the Products in the relative cart.

In any case, the Customer is assisted, in his purchases, by the legal guarantee of conformity of the goods referred to in articles 128 et seq. cod. cons.

  1. ORDER BILLING

The invoice is issued to professionals who explicitly request it when placing the order and who will care to enter the necessary data, VAT number or tax code, and SDI code for professionals with an Italian VAT number. The invoice will be attached to the order and will be sent by email to the buyer. For Italian companies and professionals, a copy of the electronic invoice without tax value will be sent as an attachment to the order and by email. The customer will then receive the electronic invoice in their tax file (cassetto fiscale).

  1. ORDER OF PRODUCTS

The site www.salumificiopevericarlo.com proposes the sale of food products processed in the Peveri Carlo company, guaranteed in terms of quality and in compliance with the relevant European standards.

All products are described in detail in a sheet that illustrates their characteristics, specificity, weight, availability and indicates the code and the relative cost. In this regard, it should be emphasized that only and exclusively the product sheet is authentic in relation to the acquisition of any type of information on the product itself.

Before proceeding with the order, the buyer must register on the site, creating a personal account that presupposes the entry of sensitive data necessary for the purpose of completion of the order and the consequent shipment of the purchased goods.

After registering your account and after accepting the General Conditions of online sale and the legislation governing privacy, the buyer can proceed to place the order by entering the data relating to the quality of the chosen product directly by clicking on the electronic card of the product itself which is then directed to the cart. The data are made visible in an explanatory and summary screen of all useful information.

The Customer must put the Product in the appropriate “cart” and, after having read the General Conditions, with particular reference to the contribution for delivery costs and the methods of exercising the right of withdrawal, and the Privacy Policy, must select the desired payment method and choose the “send order” option.

Before submitting your purchase order, the customer will have the opportunity to correct any data entry errors by following the appropriate modification procedure contained in the site. In particular, the customer has the right to change the quantity of the products he intends to purchase, adding or removing one or more products from the “cart”.

At the time the buyer submits the electronic order he also proceeds to send an online contractual proposal, in addition to confirming that he accepts all the general conditions according to which it is regulated. The contract proposal is concluded once the order is accepted by the seller.

After receiving the buyer’s order, the seller is obliged to immediately check the availability of the product to be fulfilled.

It will be the seller’s responsibility to communicate, via an informative e-mail to the buyer’s electronic address, any unavailability of the product, as well as providing the suggestion of alternative products.

It will be the responsibility of the buyer to notify the seller, within 12 hours of receiving the information email, if he intends to definitively cancel the order or if he intends to proceed with the purchase of the products indicated as an alternative to those not available. In the event that the buyer does not provide any response within the indicated timeframe, the seller will consider the proposal to purchase the alternative products available tacitly accepted,  and these products will be sent to the buyer thus proceeding with the completion of the order and payment of the amount due, not charging the buyer for any difference in cost that may arise due to unavailable products. In the event that the buyer refuses the alternative offered by the company, he will be entitled to a coupon without expiration that can be used for further purchases on the website The maximum value of the coupon is 40 €, beyond that amount the buyer and the seller will agree on how to return the money. As long as the coupon is not present on the site, Salumificio Peveri Carlo will have the duty to agree with the customer regarding the return methods.

The seller, after accepting the order, provides confirmation to the buyer by sending an e-mail which, in addition to the aforementioned confirmation, contains a summary table of all relevant information: list of products and price including VAT, the order number, the data relating to the shipping and billing address, and any costs for delivery.

The buyer will take care to check that there are no errors. Should she/he find them, she/he undertakes to send an informative e-mail to the seller’s electronic address, info@salumificiopevericarlo.com, within 12 hours of receiving the summary table of the order. After this time interval, the order will be considered tacitly confirmed by the buyer and the seller will be able to proceed with its evasion and the organization of the shipment of the package of the ordered products.

  1. PAYMENT METHODS

Payment can be made by credit card, Paypal and bank transfer, prepaid card and cash on delivery (only possible for shipments with delivery on the Italian territory) as indicated on the Site.

After confirming the order through the Site, the customer will be redirected to the following sites:

  • Credit card: Visa / Visa Electron, Mastercard / Maestro, American Express, PostePay, Carta Aura, Discover.
  • Paypal manages the payment according to its own maximum security protocol.

The data provided for payment by credit card or bank account are transmitted encrypted directly to the bank that authorizes the payment. No data relating to the inserted credit card or bank account for payment is sent to the Peveri site nor can it be saved in the archives of the Peveri site.

Once the payment operations have been completed, the customer will be automatically directed to the Salumificio Peveri Carlo s.a.s. site for the conclusion of the order.

Payment by cash on delivery, for shipments to Italy only, allows the buyer to pay in cash upon delivery of the ordered products. The cost of this method of payment is added to the total amount due for the order.

Payment by bank transfer can be made after the communication of the seller’s IBAN data and must be made within 3 days from the time of communication. After this period of time, the order is deemed canceled.

For payment by credit card or PayPal, the relevant invoice will be issued when the product is delivered to the courier who will take care of the transport.

  1. CONFIRMATION OF RECEIPT OF THE ORDER

The order is considered processed once the various intermediate technical phases have been completed and the total amount paid, and Salumificio Peveri will be responsible for sending: the order confirmation, purchase receipt complete with the General Conditions and Terms of the contract by email to the ‘address indicated during the order.

  1. INEFFECTIVENESS OF THE ORDER

No contract must be considered concluded between Salumificio Peveri and the Customer if Salumificio Peveri has reasonable grounds to believe that the Customer does not operate on the basis of an effective and genuine interest in purchasing the Products ordered, or abuses the right of withdrawal.

In such cases, the order sent by the Customer must be considered ineffective, Salumificio Peveri will send the Customer, by e-mail, a communication certifying the non-conclusion of the Contract, also taking care of the cancellation of any charge and/or expense charged to the Customer.

  1. SHIPPING, DELIVERY TIME, DESTINATIONS AND COSTS

Salumificio Peveri delivers to all countries belonging to the European Union.

Salumificio Peveri will make use of transporters such as SDA, UPS, TNT, DHL, FEDEX in Italy through the intermediation of Mail Boxes Etc (MBE) which will allow a faster and more thorough check on your shipment.

Salumificio Peveri will make use of transporters such as for international shipments always through the intermediation of MBE.x

Once the Product has been shipped, Salumificio Peveri will send an e-mail or a text message to the Customer with the shipment number so that it can be tracked.

Salumificio Peveri’s goal is to always safeguard the product, guaranteeing its perfect conservation throughout the journey: for this reason, dry ice is used as a refrigerant when necessary. The utmost care is also taken in the packaging of the products, using polystyrene boxes that preserve the contents from sudden changes in temperature and accidental bumps. The goods travel at the risk of Salumificio Peveri: in case of damage, however, the Customer is asked to help improve the service by accepting the parcels with reserve. The Customer is asked to always check at the time of delivery:

  1. the presence of all products actually shipped and invoiced;
  2. the integrity of the packaging.

We do not accept complaints for missing products (compared to what is actually invoiced) or for any breakages if the shipment has not been accepted with reserve.

The ordered Product will be shipped to the postal address specified by the Customer.

Salumificio Peveri recommends indicating a delivery address that is always attended –  so that the package can be received – and verifying its content and integrity.

No responsibility in any capacity may be charged by the Customer to Salumificio Peveri in case of delay in the order or delivery of the Products covered by the purchase contracts.

However, the supply times depend on factors external to Salumificio Peveri’s will, such as the commercial policies of the suppliers, while the delivery times will be diversified in consideration of a series of circumstances, including the method of payment, and the place of delivery and the availability of couriers.

Sometimes it is possible that the goods are not available in stock due to simultaneous multiple orders that lead to the end of stocks or in the case of special products that must be produced. Salumificio Peveri will communicate the estimated delivery times and will try to provide delivery as soon as possible.

  1. COMPLAINTS

The buyer can communicate any complaint by sending an e-mail to the e-mail address info@salumificiopevericarlo.com, by calling +39.0523.940156, or by sending a registered letter with return receipt to the address: Salumificio Peveri Carlo Sas – Via Chiaravalle 3193/1 – Chiaravalle della Colomba-ALSENO (PC). The seller undertakes to provide an answer within a maximum of 7 days from the moment in which he receives the communication from the buyer containing the complaint.

  1. ARCHIVING AND REVIEWING THE ORDER

Once the order has been forwarded, the Customer has 24 hours to make changes to the order, including changes in goods and those relating to the delivery address. The customer must call Federica at the administration office, at +39 0524 940156 and send an email to the following email address: info@salumificiopevericarlo.com

  1. Right of withdrawal (consumer code D. LGS 206/05 and D. L. 21/2014)

In accordance with art. 52 of Legislative Decree 206/2005 (Consumer Code), the Customer has the right to withdraw from this agreement for any reason within 14 days of delivery of the Product.

To exercise this right, the Customer must send a communication to that effect, by registered letter with return receipt, within 14 (fourteen) working days from the date of receipt of the goods.

The substantial integrity of the goods to be returned is an essential condition for exercising the right of withdrawal. Once the integrity of the returned product has been verified, Salumificio Peveri will refund the customer the full amount paid for the products referred to in the purchase contract subject to withdrawal, no later than 14 days from the return of the products.

Salumificio Peveri will refund the entire value of the order, or part of it if the withdrawal was partial, by bank transfer, or by other methods specifically agreed between Salumificio

Peveri and the Customer.

As required by the Consumer Code Legislative Decree 206/05 (ex right of withdrawal) and by Legislative Decree 21/2014, Salumificio Peveri customers enjoy the possibility of returning the products purchased within 14 working days of receipt and the Products must be returned in good condition and with original labeling.

In accordance with art. 59 of the Consumer Code the right of withdrawal does not apply to perishable goods.

– The packaging of the products must be accurate, in order to protect the original wrapping from damage, affixing of writings or labels.

– The products must be returned by refrigerated Express Courier at your own expense.

– It is advisable to use a traceable and insured shipping method as Salumificio Peveri will not be responsible for loss, non-receipt or damage to the material sent.

– The goods will be reimbursed by Salumificio Peveri after checking the content and status of the products, within 14 days of receiving the communication from the Customer. If the goods have not been returned to the Seller for the appropriate checks, the 14 days for the reimbursement will begin to run from receipt of the goods (art. 56 cod. cons.). According to art. 57 cod. cons. Salumificio Peveri, once the product has been returned, should it notice the deterioration or decrease in value of the asset due to reasons attributable to the negligence of the customer, it may possibly hold the same responsible for the lower value.

Salumificio Peveri will provide for the full reimbursement of the costs incurred by the customer upon purchase, the re-credit will take place in the manner agreed, verbally or by electronic correspondence, by the Customer and by Salumificio Peveri Carlo. The only expenses charged to the Returner are those relating to the return of the product.

If at the time of returning the product the seller should verify one or more requirements that exclude the guarantee of withdrawal, she/he has the right to return the product to the buyer again, charging the latter for the costs incurred for shipping.

  1. MISTAKES

The information relating to the Products provided on the Site is constantly updated.

However, it is not possible to guarantee the complete absence of errors.

Salumificio Peveri reserves the right to correct errors, inaccuracies or omissions even after an order has been sent and also to change or update information at any time without prior notice.

  1. PROCESSING OF PERSONAL DATA

Customer data is processed by Salumificio Peveri in accordance with the provisions of current legislation on the protection of personal data, as specified in the information in the specifically dedicated section, called “Privacy Policy”.

  1. COMMUNICATIONS

All communications or any complaints from the Customer towards Salumificio Peveri regarding the Purchase Agreements must be communicated by e-mail (info@salumificiopevericarlo.com).

  1. APPLICABLE LAW AND COURT

In the event of disputes, Italian law will be applied in cases where it is possible and compatible with the Customer’s law. Otherwise, the law of the state where the customer is based or resident will apply.

In the event of disputes relating to the interpretation, execution of this contract, and in compliance with these General Conditions, the place of jurisdiction will be the one where the Customer has her/his residence or domicile.

In particular, pursuant to articles 1341 and 1342 of the Italian Civil Code, the Customer expressly declares to approve the provisions referred to in the following articles:
